PICKLEBALL EVENT — PARTICIPANT RELEASE, ASSUMPTION OF RISK & HOLD HARMLESS AGREEMENT

PLEASE READ CAREFULLY BEFORE REGISTERING. THIS AGREEMENT AFFECTS YOUR LEGAL RIGHTS.

In consideration of being permitted to participate in the Community Alliance of Filipino Americans (“CAFA”) Pickleball Event on October 24, 2026 (the “Event”), I acknowledge and agree to the following:
 

1. VOLUNTARY PARTICIPATION

I understand that participation in the Event is completely voluntary. I am choosing to participate at my own discretion and accept responsibility for determining whether I am physically and otherwise able to participate safely.

I understand that CAFA does not require me to participate and that I may discontinue my participation at any time if I believe that continuing would be unsafe or inappropriate for me.
 

2. ASSUMPTION OF RISK

I understand that pickleball and related athletic activities involve inherent and foreseeable risks of injury, illness, property damage, and, in extreme circumstances, serious injury, permanent disability, or death.

These risks may include, but are not limited to:

  • Falls, slips, trips, and collisions;

  • Contact with other players, spectators, officials, equipment, nets, fences, walls, or other objects;

  • Sprains, strains, muscle injuries, fractures, dislocations, and other orthopedic injuries;

  • Head, neck, back, joint, or eye injuries;

  • Concussions or other traumatic injuries;

  • Dehydration, heat-related illness, exhaustion, or other environmental conditions;

  • Cardiac events or other medical emergencies;

  • Injuries resulting from my own physical condition, actions, or inaction;

  • Injuries resulting from the actions or inaction of other participants, spectators, volunteers, officials, or other persons;

  • Equipment malfunction or improper use of equipment;

  • Conditions of the courts, facility, parking areas, walkways, or other areas associated with the Event; and

  • Other risks that may not be known or reasonably foreseeable at this time.

I knowingly and voluntarily assume all such risks, whether known or unknown, foreseeable or unforeseeable, arising from or related to my participation in the Event.
 

3. RELEASE AND WAIVER OF LIABILITY

To the fullest extent permitted by applicable law, I hereby release, waive, discharge, and covenant not to sue Community Alliance of Filipino Americans (CAFA) and its officers, directors, members, employees, volunteers, representatives, agents, event organizers, sponsors, contractors, and affiliated organizations, as well as the owners, operators, employees, agents, and representatives of any facility used for the Event (collectively, the “Released Parties”), from any and all claims, demands, causes of action, damages, losses, liabilities, costs, or expenses arising out of or related to my participation in, attendance at, or presence at the Event.

This release includes claims arising from personal injury, illness, disability, death, or property damage, including claims arising from the ordinary negligence of a Released Party, to the fullest extent permitted by applicable law.

This agreement does not release or waive claims to the extent that such a waiver is prohibited by applicable law.
 

4. HOLD HARMLESS AND INDEMNIFICATION

To the fullest extent permitted by applicable law, I agree to indemnify, defend, and hold harmless the Released Parties from and against claims, demands, damages, liabilities, losses, costs, and reasonable expenses, including reasonable attorneys’ fees, arising out of or related to:

My participation in or attendance at the Event;
My negligent or wrongful acts or omissions;
My violation of Event rules or instructions; or
Any claim brought by or on behalf of me arising from my participation in the Event.

5. PERSONAL RESPONSIBILITY AND MEDICAL FITNESS

I understand that I am responsible for determining whether participation in the Event is appropriate for me based on my physical condition and abilities.

I represent that I am physically capable of participating in the activities I choose to undertake and that I will not participate if I believe doing so would create an unreasonable risk to myself or others.

I understand that CAFA is not providing medical advice, medical supervision, or medical insurance for participants.
 

6. EMERGENCY MEDICAL CARE

In the event of an injury, illness, or medical emergency, I authorize Event organizers, volunteers, emergency personnel, or other appropriate persons to obtain or arrange reasonable emergency medical assistance for me when deemed necessary.

I understand that I am responsible for any medical, ambulance, hospital, treatment, or other expenses incurred on my behalf.
 

7. EVENT RULES AND SAFETY

I agree to follow all reasonable Event rules, court rules, facility requirements, safety instructions, and directions provided by Event organizers, officials, volunteers, or facility personnel.

I understand that CAFA or Event organizers may remove me from participation if my conduct is unsafe, disruptive, inappropriate, or inconsistent with Event rules.

I agree to exercise good judgment, sportsmanship, and reasonable care for my own safety and the safety of others.
 

8. EQUIPMENT

I understand that pickleball equipment may be provided by me, another participant, the Event, or the facility. I agree to use equipment responsibly and in accordance with applicable instructions.

I acknowledge that CAFA does not guarantee the condition, suitability, or safety of any equipment that I choose to use.
 

9. PERSONAL PROPERTY

I understand that CAFA is not responsible for lost, stolen, or damaged personal property brought to or left at the Event.


10. PHOTOGRAPHY AND RECORDING

I understand that photographs, video, or other recordings may be taken during the Event.

By participating in the Event, I grant CAFA permission to use photographs or recordings of me taken during the Event for CAFA's legitimate promotional, informational, social-media, or archival purposes, without compensation, unless I notify CAFA in writing that I do not consent to such use.


11. ELECTRONIC ACCEPTANCE

I understand that my electronic acknowledgment of this agreement constitutes my signature and acceptance of its terms.


By checking the acknowledgment box during registration, I confirm that:

  • I have read this entire agreement;

  • I understand that pickleball and athletic activities involve inherent risks;

  • I voluntarily assume those risks;

  • I understand that I am releasing certain legal claims;

  • I agree to the release, waiver, indemnification, and hold-harmless provisions above;

  • I am voluntarily choosing to participate in the Event; and

  • I agree to be bound by this agreement.
     

12. SEVERABILITY

If any provision of this agreement is determined to be invalid, unenforceable, or prohibited by applicable law, that provision shall be limited or severed to the minimum extent necessary, and the remaining provisions shall continue in full force and effect to the fullest extent permitted by law.
 

13. ACKNOWLEDGMENT

I acknowledge that I have had the opportunity to read this agreement carefully and ask questions regarding its meaning before registering for or participating in the Event.

I understand that I am giving up certain legal rights by agreeing to this Release, Assumption of Risk, and Hold Harmless Agreement, and I voluntarily agree to its terms.
 

By selecting “I Agree” and submitting my registration, I electronically acknowledge and agree to all terms of this Participant Release, Assumption of Risk & Hold Harmless Agreement.
 

I HAVE READ, UNDERSTAND, AND AGREE TO THE COMMUNITY ALLIANCE OF FILIPINO AMERICANS PICKLEBALL EVENT PARTICIPANT RELEASE, ASSUMPTION OF RISK & HOLD HARMLESS AGREEMENT.
